User Terms and Conditions

This User Terms and Conditions shall govern the use of Cooperative Health Management Federation (CHMF) Mobile Application, Webtool, and Website by Member-Cooperatives, Enrollees, guests, and other stakeholders of the CHMF ("Federation").

Terminologies

1.   "CHMF Mobile Application" is a portal designed and configured for Android and iOS smartphones that will allow Enrollees to access their accounts and the Services of the Federation whenever and wherever they are using a mobile smart phone with access to data service.  This Mobile App is available for download at Google Play Store and Apple App Store.

2.   "CHMF Webtool" is an alternative method of accessing the Services of the Federation instead of using the Mobile Apps. This tool is usually offered to selected Users as the Federation may allow.

3.   "CHMF Website" is a collection of related pages, that include multimedia contents, typically identified as www.chmf.coop. This is where information about the Federation can be found.

4.   "Services" are health management products that CHMF offers to its Member-Cooperatives and Enrollees. This includes other products that CHMF will offer in the future, such as, but may not be limited e-loading, bills payments, remittance, etc., for the convenience of the Federation's Member-Cooperatives, Enrollees, Users, and other stakeholders.

5.   "Enrollee" refers to an Individual Member of any Member-Cooperative of the Federation, who is at least 18 years old, duly registered and authorized to use the Services of the Federation using his/her account/s in accordance with this User Terms and Conditions and the Federation's other policies.

6.   "Account"refers to the access login credentials that contain all the files, resources, and information belonging to one Enrollee or User.

7.   "Cooperatives" refers to the cooperatives that are members in good standing of the Federation. 

 

 

Access to CHMF Account

Access to CHMF account by an Enrollee through the CHMF Mobile Apps or by the Member-Cooperative through the CHMF Webtool shall be through the use of Username/s and Password/s.  A One-Time Password (OTP) is generated for the activation of Enrollee account  before an Enrollee is able to use the Services.

Activation Requirements

The following shall be the minimum required information to comply with the verification process of a valid Enrollee's account with CHMF:

a.   Policy Number
b.   Date of Birth
c.   Mobile Phone
d.   Email Address

The Enrollee shall enter his/her Policy Number and Date Of Birth in the Mobile App and upon system verification that the Enrollee account is valid, the Enrollee shall be requested to enter his/her Mobile Phone and Email Address. This is followed by an OTP received via the Enrollee's mobile phone to complete the activation process. Once completed, the Enrollee shall receive his/her Username and Password to access his/her CHMF account.

CHMF shall validate the information provided and reserves the right to disapprove, reject, or deny activation once validation is not completed or other required information is not established with certainty.

Activation

After registration, the Enrollee's account will be activated by CHMF System Administrator.

Once activated, the Enrollee shall receive a text message (SMS) informing the validation of CHMF requirements and may proceed with Pre-Funding to enjoy the Services.

Username and Password

Upon registration, CHMF will provide the Enrollee with a system-generated Username and Password. the following shall be strictly observed in relation to Usernames and Passwords:

1.   System-generated Password/s should be immediately changed by the Enrollee.

2.   It is the Enrollee's full responsibility to keep his/her Username and Password confidential and secured.

3.   Any transactions done in the account is conclusively presumed to have been done by the Enrollee or with his/her authority.

4.   CHMF and its employees shall not be held accountable for any losses of funds in an account due to mishandling of Username/s and Password/s.

5.   As a safety measure, Enrollees should change their Password/s from time to time.

User Responsibility and Liability

1.   Users shall keep CHMF customer information and data confidential and secured at all times and shall only upload such information and data to the CHMF System through the use of the CHMF Mobile Application or Webtool.

2.   User assumes full responsibility and accountability on any transactions done by his/her authorized representative using the User's account.

3.   CHMF shall be held free and harmless of any damages and losses suffered by the User's customer by reason of the User's fault, negligence, and wilful misconduct.

Services

1.   Health Package. Enrollees or Users may use their CHMF account/s to access their profile and information to include their basic profile, history of medical availment, and list of accredited Health Maintenance Organization (HMO) partners of CHMF; and to request for an appointment with preferred HMO partners of CHMF.

      CHMF reserves the right to disclose to its HMO Partner any matter pertaining to Enrollee's account as may be necessary for the operation of CHMF Services.  For this purpose, CHMF and its affiliates are hereby held free and harmless from any and all liabilities, claims, demands, and suits of whatever nature arising out of, or in connection with, such disclosure.

2.   Change Password. A User may change his/her Password within the CHMF Mobile App by indicating his/her User-nominated Password.  The same Password cannot be used for three (3) consecutive changes. A new Password can only be used once a confirmation text message (SMS) from CHMF has been received.

CHMF Authority

1.   CHMF has the sole authority to authenticate Username/s and Password/s.

2.   CHMF reserves the right to approve Enrollee activation based on the requirements submitted. In case of doubt and reasonable grounds, CHMF has the authority to reject submitted Enrollee requirements and may require additional documents and information.

Accuracy of Information

1.   CHMF shall use reasonable efforts to ensure accuracy of the information accessed through its Services.  However, CHMF does not warrant that information therein shall be free from error.

2.   CHMF and its affiliates shall be free from harm and liability on whatever erroneous information supplied by the Enrollee or User into the CHMF Services.

3.   In cases of erroneous data or information was unintentionally supplied by Enrollee/User, the same shall be reported immediately to CHMF in writing within reasonable time from discovery of error.

4.   CHMF and any of its officers and representatives, and any of its affiliates and/or partners shall be held free and harmless from any liabilities, claims, damages, suits of whatever nature, arising out of or in connection with the implementation of this arrangement, including any and all errors inadvertently committed, any system-related errors resulting in CHMF failure to effect any transactions.

5.   CHMF will not be liable for any losses resulting from circumstances beyond the control of CHMF.  These include, but are not limited to, failure of electronic or mechanical equipment or communication lines or other interconnect problems, severe weather, earthquakes, floods, or such other events.

 

General Agreements

1.   It is understood that the CHMF Mobile App is for personal use and convenience. 

2.   It is the duty and responsibility of the Enrollee/User to check CHMF Website regularly for any updates, announcements, advisory, instructions, and/or changes/revisions of this User Terms and Condition.

3.   Continued use and patronage of the Services after revisions of this User Terms and Conditions shall constitute consent and agreement with the changes and revision.

4.   In cases of loss of mobile phone/s where CHMF is installed, Enrollee/User should call the hotline and email a report with request to block the account.

5.   CHMF may terminate the availability of any Services mentioned in this User Terms and Conditions, subject to prior notice and announcement.

6.   CHMF or any of its affiliates shall not be liable for any loss or damage of whatever nature in connection with the implementation of mobile transactions in the following instances:

a.   Disruption, failure, or delay relating to or in connection with CHMF Services which are due to circumstances beyond the control of CHMF, unforeseen events, fortuitous events, such as, but not limited to, prolonged power outages, breakdown of computers, systems glitch, software, operating systems and telecommunication facilities, typhoons, floods, public disturbances, and calamities and other similar or related cases.

b.   Loss or damage arising out of any fraudulent access or utilization of the CHMF Services due to unauthorized usage of Username and Password or violation of other security measures used for CHMF.

c.   Any indirect, incidental or consequential loss or damage suffered by reason of the improper use or inability to use the CHMF Services.

 

 

Termination

1.   An Enrollee/User may request the termination of an  Enrollee account registered in the Mobile App  by sending a written request to Customer Service and giving CHMF five (5) working days to process the request.  

2.   This User Terms and Conditions shall remain in full force and effect prior to cancellation/termination of Services.

3.   Termination or cancellation of account shall be without prejudice to any liability and payables incurred prior the termination.

4.   CHMF, for reason of security and safety, may withdraw, cancel, or terminate CHMF Service/s, with due notice provided for the reason thereto.

5.   CHMF may suspend or terminate with notice in case of Enrollee/User death, bankruptcy, or lack of legal capacity.

6.   Any breach of this User Terms and Conditions may warrant suspension or termination of Enrollee/User account/s and forfeiture of wallet funds.

Miscellaneous

This User Terms and Conditions and other related or supplemental CHMF policies, procedures, rules, and charges may be changed from time to time, or as necessity arises, with prior notice to all stakeholders.  Any changes will be effective from the date of notice or such later date as may be specified therein. Changes shall also be posted in the CHMF Website and other communications media as may be expedient under the circumstances.

 

Data Privacy Agreement

Peppermint Innovation Limited (hereinafter referred to as "Developer") built this mobile app or platform for the Cooperative Health Management Federation (hereinafter referred to as "Federation") as a free-to-download app. This Service is provided by the Federation at no cost and is intended for use as is.

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.

If you choose to use our Service, then you agree to the collection and use of information in relation to this Data Privacy Agreement (hereinafter referred to as the "DPA"). The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this DPA.

The terms used in this DPA have the same meanings as in our User Terms and Conditions, which is accessible at http://chmf.coop/app/utc unless otherwise defined in this DPA.

Governing Law and Regulations

The Developer and the Federation jointly consider the matter of privacy in general, and data privacy in particular, central to the use, function, and operation of this app, and treat it as a human, organizational, legal and regulatory obligation.

This DPA is in compliance with Republic Act No. 10173 (August 15, 2012), also known as the "Data Privacy Act of 2012," and its Implementing Rules and Regulations (August 24, 2016).

Principles and Interpretation

As such, the provisions of this DPA follows the principles of Rep. Act No. 10173, such as, but not limited to, but with particular importance to the following:

Information Collection and Use

For a better experience, while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to:

Log Data

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third-party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

This Service does not use these "cookies" explicitly. However, the app may use third-party code and libraries that use "cookies" to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

Third-Party Service Providers

We may employ third-party companies and individuals due to the following reasons:

  1. To facilitate our Service;
  2. To provide the Service on our behalf;
  3. To perform Service-related services; or
  4. To assist us in analyzing how our Service is used.

 

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Security

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is one hundred percent (100%) secure and reliable, and we cannot guarantee its absolute security.

Privacy of Non-Enrollees

These Services do not address anyone who is not or who is not qualified to be an enrollee to the app, particularly children, and minors. We do not knowingly collect personally identifiable information from non-enrollees, children, and minors. In the case we discover that a non-enrollee, child, or minor has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

Changes to this DPA

We shall update our DPA from time to time. Thus, you are advised to review this page periodically for any changes.

We reserve our right to proactively modify, amend, edit, amend, revise, or otherwise implement other changes, as it would be our legal obligation to, in compliance with other, additional, or more stringent data privacy requirements in other jurisdictions that may have extra-territorial implications affecting the Federation, its co-operative members, and individual members, such as the General Data Protection Regulation (effective May 25, 2018) of the European Union.
