JUICE Terms of Use

 

Welcome to the JUICE Terms of Use (also known as the “JUICE Terms of Use” or “Terms”) for the JUICE academic skill-building and learning system (also known as the “Website”). JUICE provides just-in-time, friendly, and interactive learning resources to help you review and practice important skills for college success. JUICE is being developed by Southern New Hampshire University (also known as “SNHU”) with a federally-funded grant and is currently in its pilot testing phase. These Terms lay out the ground rules relating to your access to and use of the JUICE Website. You can access and use this Website only if you accept and comply with these Terms and are capable of forming a binding contract with SNHU. You must also agree to comply with the JUICE Privacy Policy and any local, state, national, and international laws, rules, and regulations that may apply to you. By using or logging into the Website, you automatically agree to these Terms and to our Privacy Policy. These Terms also apply to all visitors, users, and others who access or use the Website.

1. Registration and Access

Accessing the Website requires registration. To register an account, you must be at least 13 years old. You will need to provide correct, current, and complete information to register your account. The information you provide to register your account and other information you provide through the use of any features on the Website are governed by the JUICE Privacy Policy. You agree to all actions SNHU takes with respect to your information consistent with the JUICE Privacy Policy.

If you connect to the Website through a third-party service, such as a social media platform, you give permission for SNHU to use a third party service, Janrain, Inc. to identify you for purposes of creating a personal account in the Website and authenticating your identity when you access the Website.

You agree to keep your Website user name, password, and other login information confidential and to notify SNHU at JUICEinfo@snhu.edu immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to exit from your account by logging out of the Website and your social media app at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You are responsible for any activities or actions that occur under your username. SNHU is not liable for any loss or damage arising from your failure to comply with the above requirements.

2. Updates to Terms

SNHU may change these Terms at any time, so you should check this page regularly for updates. All changes to the Terms are effective immediately after SNHU posts them and apply to all access to and use of the Website thereafter. By continuing to use or log into the Website after these Terms have changed, you indicate your agreement to the revised Terms. If you do not agree to the changes, you should stop using and/or logging into the Website.

3. Availability of the Website

SNHU makes no guarantee that the Website will be available at any particular time and reserves the right to withdraw or amend the Website, and any features, functions, or material SNHU provides on the Website, without notice. SNHU reserves the right to disable any account at any time for any or no reason, including if, in SNHU’s opinion, you have violated any provision of these Terms of Use.

4. Use of Website

You agree not to use the Website in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Website or any of its features or functionality. If SNHU, in its sole discretion, determines that you have acted inappropriately, SNHU reserves the right to remove any Input that you have generated, terminate your account, prohibit you from using the Website, and/or take appropriate legal actions.

5. Intellectual Property

The underlying code and content on the original Website created with federal funding will be placed in an open repository on or before September 30, 2018 and is considered open source.

However, SNHU retains all intellectual property rights associated with the name, brand name, trademarks, service marks and logos of SNHU, including, but not limited to, the words “College for America,” “Southern New Hampshire University,” and “SNHU”; the corresponding logos; and all current and future trademarks, service marks, designs, or logos used by the University.

6. Input

In your use of the Website, you represent and warrant that you have the right to provide any data that you enter or create into the Website (“Input”). The Input that you provide to use any of the features or functionality of the Website belongs to you. However, you agree to grant SNHU a world-wide, non-exclusive, irrevocable, transferable, perpetual, royalty free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, edit, translate, make derivatives, display, and distribute such Input in connection with providing the Website to you and other users in accordance with the JUICE Privacy Policy and these Terms. In connection with providing the Website, SNHU may modify or adapt your Input in order to transmit, display, or distribute it over computer networks and in various media and/or make changes to your Input as necessary to conform and adapt that Input to any requirements or limitations of any networks, devices, services, or media. SNHU also reserves the right to access, read, preserve, and disclose any information as SNHU reasonably believes is necessary to: (i) satisfy any applicable law, regulation, legal process, or governmental request; (ii) enforce the Terms, including investigation of potential violations; (iii) detect, prevent, or otherwise address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect the rights, property, or safety of SNHU, its users and the public. You agree to indemnify, release, and hold SNHU harmless from any and all liability arising from any Input you provide.

7. Copyright Infringement

If you believe that any information on this Website violates your copyright or to report copyright infringement, please contact JUICEInfo@snhu.edu.

8. Links from the Website

Links to other sites and resources provided by third parties that are displayed on the Website are provided for your convenience only. SNHU has no control over the contents of those sites or resources, and SNHU accepts no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to this Website, you do so entirely at your own risk and subject to the terms and conditions of use and privacy policies for such websites.

9. Electronic Communications

When you use the Website or send communications to SNHU or JUICE through the Website, you are communicating with SNHU electronically. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices from SNHU intended for receipt by you shall be deemed delivered and effective when sent to an email address you provide to SNHU via the Website.

10. No Warranties and Limitation of Liability

THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE WEBSITE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, SNHU AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE OR CORRECT; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 11. Children Under The Age of 13

The Website is not intended for use by children under 13 years of age. No one under age 13 years of age may provide any information to the Website. If you are under 13, do not use or provide any information on this Website or on or through any of its features or register on the Website.

12. FERPA

If you are using the Website in conjunction with a third-party learning management system, you agree that SNHU may provide information that may be considered student records under FERPA to your home institution under the terms of and as described by JUICE’s Privacy Policy.

13. Geographic Restrictions

The owner of the Website is based in the state of New Hampshire in the United States. SNHU makes no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

14. Governing Law

All matters relating to the Website and these Terms and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of New Hampshire without giving effect to any choice or conflict of law provision or rule (whether of the State of New Hampshire or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of New Hampshire. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

15. Waiver and Severability

No waiver by SNHU of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of SNHU to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
